CV NEWS FEED // A Wyoming doctor whom Gov. Mark Gordon removed from the state’s board of medicine over his opposition to “trans” procedures filed a lawsuit earlier this year asking the court to put him back on the board.
On October 1, Dr. Eric Cubin’s attorneys filed for a preliminary injunction in an attempt to reinstate him until the court reaches a decision on the case.
CatholicVote reported in August that Cubin, a radiologist who until April had served on the Wyoming Board of Medicine, sent an email to the state House of Representatives in February expressing his support of a bill that almost entirely banned procedures aimed at “changing” a minor’s gender, including surgeries, hormone therapy, or puberty blockers.
Cubin’s email additionally criticized the Wyoming Medical Society (WMS), which he is a member of, for not supporting the bill and for unfairly representing the differing views of its members.
Though Gordon, a Republican, eventually signed the bill in March, the Daily Signal reported that he did it “grudgingly.” One month later, Gordon notified Cubin via email that he was being removed from the board, stating, “It is important that the professionals governed by the Board of Medicine have confidence that board members prosecute their responsibilities on the board in an objective and unbiased way.”
“I believe your comments on this particular legislation could give doctors, who are licensed by the board of medicine, a reason to be concerned that you might use your position to advocate for a particular position when considering matters that should be considered absent an agenda or prejudice,” Gordon continued.
Gordon’s email accused Cubin of speaking for the entire Board in his support of the bill and critique of the WMS.
Cubin sued Gordon on August 29, claiming that the governor violated his constitutionally protected free speech rights. He also argued that his email to the House did not misrepresent his status as a private citizen. According to the lawsuit, he identified himself as writing “on his own behalf” and “from the perspective of a Wyoming doctor who actually practices medicine at the very hospital where he was born,” rather than that of a spokesperson for the Board of Medicine.
Cubin’s situation has also been met with complaints from Wyoming residents, who have sent Gordon more than 5,300 petitions calling for Cubin to be reinstated.
