
CV NEWS FEED // Amidst an ongoing dispute with the Biden administration over his state’s enforcement of immigration laws, Republican Gov. Greg Abbott issued a “statement on Texas’ constitutional right to self-defense,” arguing: “The federal government has broken the compact between the United States and the states.”
“The failure of the Biden Administration to fulfill the duties imposed by [Article IV, Section 4 of the U.S. Constitution] has triggered [Article I, Section 10, Clause 3], which reserves to this state the right of self-defense,” Abbott wrote in the statement. “For these reasons, I have already declared an invasion … to invoke Texas’s constitutional authority to defend and protect itself.”
Abbott posted to X (formerly Twitter) Wednesday afternoon.
“The Texas National Guard, the Texas Department of Public Safety, and other Texas personnel are acting on that authority, as well as state law, to secure the Texas border,” Abbott went on.
“The Executive Branch of the United States has a constitutional duty to enforce federal laws protecting States, including immigration laws on the books right now,” he explained. “President Biden has refused to enforce those laws and has even violated them. The result is that he has smashed records for illegal immigration.”

Abbott argued that Biden has “violated his oath to faithfully execute immigration laws enacted by Congress.”
“Instead of prosecuting immigrants for the federal crime of illegal entry, President Biden has sent his lawyers into federal courts to sue Texas for taking action to secure the border,” Abbott wrote.
The Republican also slammed Biden’s policy of allowing migrants’ “en masse parole into the United States.”
He continued:
By wasting taxpayer dollars to tear open Texas’s border security infrastructure, President Biden has enticed illegal immigrants away from the 28 legal entry points along this State’s southern border – bridges where nobody drowns – and into the dangerous waters of the Rio Grande.
“Under President Biden’s lawless border policies, more than 6 million illegal immigrants have crossed our southern border in just 3 years,” Abbott pointed out. He indicated that this is more people than the populations of 33 out of the 50 states in the U.S.

Earlier this week, Abbott ordered his state’s national guard to keep securing vulnerable areas of the southern border, despite a Supreme Court ruling that sided with the Biden administration on Monday.
“Texas’ razor wire is an effective deterrent against the illegal border crossings encouraged by Biden’s open border policies,” Abbott wrote on X Wednesday morning. “We continue to deploy this razor wire to repel illegal immigration.”
The previous afternoon, CBS’ Camilo Montoya-Galvez posted a video of National Guard soldiers putting wire in place in Eagle Pass, a border city known for being a hotbed of illegal crossings.
Videos also show that Shelby Park was one of the locations in the city where soldiers installed wire. The 47.4-acre park is situated along the banks of the Rio Grande, making it an ideal place for many migrants to enter into the country.
Jorge Ventura of NewsNation reported that the Texas Military was “doubling down by installing more razor wire and anti-climb fencing in” the park.
“[W]e have not seen [Border Patrol] agents try to come in and cut the wire,” he wrote Tuesday evening. [On Monday], the Supreme Court allowed the Biden administration to remove this wire but Texas is still blocking Border Patrol from processing migrants in this area.”
Wednesday morning, Ventura posted a video to X showing Abbott’s razor wire appearing to successfully stop three Venezuelan nationals from crossing into the country via Eagle Pass park.
“Migrants say they’ve been waiting for 3 days on the riverbank to enter,” he explained. “Federal agents are not allowed to enter Shelby Park and don’t have access to cut the razor wire here.”
The official X account for the Texas National Guard stated Tuesday evening:
The Texas Military Department continues to hold the line in Shelby Park to deter and prevent unlawful entry into the State of Texas. We remain resolute in our actions to secure our border, preserve the rule of law, and protect the sovereignty of our State.
“Oklahoma stands with Texas,” Oklahoma Republican Gov. Kevin Stitt wrote on X shortly after Abbott unveiled his statement Wednesday.
The two sections of the Constitution Abbott cited to justify Texas’ right to self-defense were both added by the framers to protect states.
Article IV, Section 4 declares:
The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened) against domestic Violence.
Meanwhile Article I, Section 10, Clause 3 states:
No State shall, without the Consent of Congress, lay any Duty of Tonnage, keep Troops, or Ships of War in time of Peace, enter into any Agreement or Compact with another State, or with a foreign Power, or engage in War, unless actually invaded, or in such imminent Danger as will not admit of delay.
