
CV NEWS FEED // The United States Court of Appeals for the Fifth Circuit placed a hold on a Texas immigration enforcement law just hours after the Supreme Court ruled that it could go into effect.
A three-judge panel of the Fifth Circuit ruled 2-1 to again place a hold on SB 4, which Texas Gov. Greg Abbott signed in December.
The law empowers police to arrest suspected illegal migrants. It also allows local judges to order illegal immigrants deported to Mexico.
According to FOX News, Abbott’s signing of SB 4 “marked the most significant effort by a state to take control of enforcement since the court struck down parts of an Arizona law in 2012.”
The Daily Wire noted that the Fifth Circuit began to hear arguments for a case challenging the law “brought by the Biden administration, along with the ACLU and other groups, that oppose the immigration law” on Wednesday.
The Fifth Circuit’s ruling was only the latest development in a continual legal battle between the Abbott and Biden administrations over the ongoing border crisis.
Hours before the panel’s decision, the Supreme Court allowed SB 4 to go into effect.
FOX reported Tuesday that the Supreme Court’s decision in turn came “a day after the [Supreme Court] extended a block on [SB 4] at the request of the Biden administration, which sued to strike down the measure.”
“The Biden administration argued that the law … would usurp federal authority on matters related to immigration enforcement,” FOX added.
Filmmaker and political commentator Robby Starbuck took to X (formerly Twitter) Wednesday to describe the recent series of events concerning SB 4.
“In the middle of the night a federal judge stopped Texas AGAIN from enforcing the law,” Starbuck wrote. “Now we wait for the Supreme Court to step in AGAIN. Every American needs to understand the Biden Admin + Democrat judges are doing everything they can to stop Texas from slowing the invasion.”
While the Biden administration argues that SB 4 would undermine federal immigration authority, the official union of the U.S. Border Patrol – a federal agency – is supporting the law.
Late Tuesday, the National Border Patrol Council (NBPC) posted a message on X praising SB 4 and blasting Biden’s handling of the border crisis.
“TX taking action against the illegal alien invasion,” NBPC wrote. “And Biden will keep on being Biden, the Anarchist in Chief, where enforcement of immigration laws has no home and the lust for political power knows no bounds.”
