CV NEWS FEED // The Biden administration’s Department of Justice (DOJ) sued Oklahoma on Tuesday over a state law that makes illegal migration a crime.
The DOJ wrote in a press release that it is suing the state “to challenge House Bill 4156 (HB 4156) under the U.S. Constitution’s Supremacy Clause and Foreign Commerce Clause.”
“Because HB 4156 is preempted by federal law and violates the U.S. Constitution, the Justice Department seeks a declaration that HB 4156 is invalid and an order enjoining the state from enforcing the law,” the press release continued.
Principal Deputy Assistant Attorney General Brian M. Boynton said via the same press release: “Oklahoma cannot disregard the U.S. Constitution and settled Supreme Court precedent.”
“We have brought this action to ensure that Oklahoma adheres to the Constitution and the framework adopted by Congress for regulation of immigration,” Boynton claimed.
Republican Gov. Kevin Stitt, signed HB 4156 into law on May 1.
Oklahoma Council of Public Affairs (OCPA) reported that the legislation makes “‘impermissible occupation,’ a crime, allowing law enforcement officials to arrest illegal immigrants.”
“I am disappointed this bill is necessary,” Stitt said upon signing HB 4156:

According to the bill, any illegal immigrant discovered in Oklahoma will be sentenced to up to one year in prison, or fined up to $500, or both. Upon release, the immigrant will be required to leave the state within 72 hours. A second offense would double both the prison time and the fine.
Back in January, the Biden administration’s DOJ sued the state of Texas over a similar law making illegal migration a crime in the state.
