
CV NEWS FEED // Two pro-life organizations have called the U.S. Supreme Court’s June 27 remand of a lawsuit that challenged the Biden Administration’s decision to mandate abortions in emergency rooms a “setback” in the pro-life movement.
CatholicVote previously reported that Idaho sued the federal government after the Department of Health and Human Services reinterpreted the Emergency Medical Treatment and Labor Act (EMTALA) to require physicians to perform abortions in emergency rooms. On June 27, the U.S. Supreme Court remanded Idaho’s lawsuit back to the 9th Circuit Court of Appeals, where the case will continue.
Susan B. Anthony Pro-Life America issued a news release expressing both disappointment at the decision and hope that the pro-life movement will prevail.
“Today’s Supreme Court decision is a setback, but our fight for babies and moms continues,” State Policy Director Katie Daniel said in the news release, adding:
The Biden administration’s EMTALA charade is a PR stunt to spread the lie that pro-life laws prevent women from receiving emergency care. It is clear that the abortion lobby has created confusion on this fact for political gain and Democrats have to rely on this false talking point because their agenda for all-trimester abortion is wildly unpopular with support from only 10% of Americans.
President Marjorie Dannenfelser called the Supreme Court’s decision “a reminder and a wake-up call that the stakes of the coming election are higher than ever for unborn children and their mothers.”
Heartbeat International also commented on the decision. The organization remarked that the remanding was confusing.
“The Court did not settle the question of whether states are required to adopt a broad and sweeping view of EMTALA that leaves them effectively powerless to protect mothers and their unborn children from elective abortion – a question which may very well come back to the Court at another time,” Danielle White, Esp., general counsel for Heartbeat International, stated in an emailed news release.
She added:
